Notes from this evening’s City Council meeting, January 26, 2010.

All Council members present.

Legal Public Hearings

G-10-01-05 – 1 speaker in favor.

G-10-01-01 – no speakers

G-10-01-02 – Casey Cox is speaking in favor of the vacation.  This is adjacent to Fulton and Pearl Street, near Henry’s Restaurant.  They want to construct an outdoor area to connect with the restaurant.  There had been an easement with the City to allow for parking.  15 x 45 area deck.  40-50 patrons could be seated.  West Central Neighborhood is on board.

Finance Committee

R-10-01-21 – passed 9-0.

Regulations Committee

G-10-01-01 – property owner of both sides of the alley so they can combine the parcels.  The property had been before the Council last year, a gas station then.

Councilwoman Brown is asking if it is combined, would it cause problems later, not having a development plan now.  Kim Bowman, City Planning, is responding that any future development would come before the Council.  It is not able to be developed as it is now.

Councilman Glynn Hines is stating he wouldn’t support a gas station, but would support other positive development in the area.  “It does make sense.”

Held, 9-0.

G-10-01-02 – Leo Vode is the owner.  To protect from vandalism.  Back area between the two buildings.  A fence will be put up between the buildings by Mr. Vode to stop traffic of people moving materials from St. Vincent DePaul to an abandoned structure across the street.  Asking to hold.  There will be an easement needed over the alley.  The owner is in Florida, hence his absence tonight.  Held, 9-0.

G-10-01-05 – Unusual in that the right-of-way hasn’t functioned as such since the 80s.  Started as a facade grant request.  Increased dining capacity is more desirable over parking.

Councilman John Shoaff – is in favor.

Councilman Harper is asking if the possibility of leasing the right-of-way had been considered.  It had been kicked around, however, this manner of handling would leave the City with some liability.  Board of Public Works and Traffic Engineering felt comfortable with this.  8-1 in favor of holding.  Councilman Harper against.
