Prosecutor’s statement on the death of Tayshawn Amere Ross

Statement from the Allen County Prosecuting Attorney’s office on the death of 10 year old Tayshawn Amere Ross.

Statement from the Allen County Prosecuting Attorney’s office:

The Allen County Prosecutor’s Office is aware of the Allen County Coroner’s determination that Tayshawn Ross’s cause of death was complications of abusive head trauma and that the manner of death has been classified as homicide.

In 2016, Desmond Ross was charged in Cause No. 02D05-1608-F3-000051 for the injuries inflicted upon Tayshawn Ross. Desmond Ross later pleaded guilty to Level 3 felony battery.

While the Coroner’s determination reflects the medical cause and manner of Tayshawn’s death, the defendant has already been prosecuted and convicted for the criminal conduct giving rise to this case. Under the Fifth Amendment to the United States Constitution and Article 1, Section 14 of the Indiana Constitution, the State is prohibited from prosecuting a defendant twice for the same offense. Accordingly, no additional criminal charges may be filed based on the same conduct.
