FWPD: Officer-Involved Shooting Investigation, 5/22/2019

The Office of the Allen County Prosecuting Attorney reviewed the police action shooting investigation that occurred on May 22, 2019, and resulted in the death of Shaquille Kelly.

News release from the Fort Wayne Police Department:

Fort Wayne, Indiana (April 28, 2023) – The Office of the Allen County Prosecuting Attorney reviewed the investigation Oct. 1, 2019 surrounding the police action shooting that occurred on May 22, 2019 in Fort Wayne, Indiana, which resulted in the death of Shaquille Kelly.

The shooting investigation was completed by the Fort Wayne Police Department and the Indiana State Police. The Prosecuting Attorney’s Office has determined that there is no evidence of criminal liability in this incident. The officer was justified in using force, as he reasonably believed that force was necessary to prevent serious bodily injury or death to himself and/or citizens of this community.

The Fort Wayne Police Department and the Indiana State Police have determined that the officer’s actions were consistent with department policy and the use of force was reasonable to prevent serious bodily injury or death to the officer and/or citizens of this community. There is no pending civil litigation for this incident.

The Attorney for the family of Shaquille Kelly received all video evidence regarding this incident Aug. 19, 2021. The lawsuit was dismissed Feb. 14, 2023.
