County Ban on Synthetic Cannibas Sale Takes Effect Sept. 10

(September 9, 2010) – An ordinance prohibiting retail establishments in Allen County from selling synthetic cannabis substances such as “K2” and “Spice” will officially go into effect on Friday, September 10.

The ordinance, approved September 3 by the Board of Commissioners, contained an “urgent necessity” clause which allows it to go into effect immediately once it is signed and posted in three public places within each of the three Commissioners’ districts as outlined by state law.

The ordinance has been posted in the following locations:

  • 1st District: New Haven City Hall, Woodburn Library, Metea Park Nature Center
  • 2nd District: City-County Building, Huntertown Town Hall, Wayne Township Trustee Office
  • 3rd District: Aboite Township Trustee Office, Waynedale Library, Fox Island Park Main Office

Any business found to be in violation of the ordinance will be subject to a civil fine of up to $2,500 for each instance. The fines will be placed into the K2 Administration Fund for the purpose of covering costs associated with enforcing the ordinance. Any law enforcement agency with jurisdiction in all or part of Allen County may enforce the ordinance.

The ordinance states that the substances are “potentially dangerous to users” and that “the long term effects are not yet known.” It goes on to state that the Board of Commissioners “believes it is in the best interest of the citizens to prohibit the sale, marketing, and offering for sale these substances in Allen County to promote an increasingly safe, healthy, and well-informed community.”
